This release and waiver of liability is made in consideration of Manhattan Dance Project’s (“MDP”) consent to my request to be present at and participate in MDP’s 2015 Summer Intensive (the “Program”).
By accepting the Terms and Conditions of this Agreement I give permission for my child to participate in the Program and acknowledge that my child has completed and turned in the event registration form.
I understand that my child’s participation in the Program may require Air Travel and/or overnight stays outside of my presence. As parent and/or legal guardian, I remain legally responsible for any personal actions taken by my child. My child’s personal effects are my child’s sole responsibility. I agree that my child will be responsible to notify a chaperone or MDP staff person if he or she has concerns or medical needs during the Program, and will not leave the event site(s) without permission from the chaperone or MDP staff.
I have been informed of the nature and activities of the Program in which my child will participate. I understand there are numerous risks associated with participation in the Program and that these risks are part of engaging in the type of physical activities which are a major component of the Program. I hereby warrant that to the best of my knowledge, my child is in good health and that I am not aware of any physical, emotional or mental problem or limitation that would prevent or impair my child’s participation or increase the risks involved. I assume all responsibility for my child’s health and physical condition.
In the event of an emergency, I hereby give permission to transport my child to a hospital or other facility for emergency medical or surgical treatment. I wish to be advised prior to any further treatment by the hospital or doctor.
With all of the above in mind, I accept and assume the Risk and Full Responsibility for injury, loss of personal property and/or other damage and expense which may result from my child’s presence at and participation in the Program, whether caused by the negligence of MDP, its agents, employees, chaperones, volunteers, or representatives, (the “MDP Parties”), or otherwise.
I hereby agree to Release, Waive, Discharge, Hold Harmless, and Promise Not to Sue the MDP Parties, and each of them for any liability to me, my heirs, next of kin and personal representatives, arising from any loss, injury, damage to person or property, claim or cause of action that may result from my child’s presence at or participation in the Program or activities incidental thereto. I further release any liability in the event my child is injured while participating in and/or traveling to and from the event. I release and consent to the use of my child’s likeness relating to communication production in any media.
Risks of Air Travel: If participation in this program requires air travel, I understand that air travel involves risks and I acknowledge and agree that MDP and its agents and chaperone assume no liability and will not be held responsible for any loss which may occur during my child’s participation in this trip, including air or other travel to and from the event. My child’s participation in this trip is voluntary and I assume the risk of participation.
This agreement is intended to be as broad and inclusive as permitted by, and shall be construed and governed under, the law of the State of Arizona. If any part of this Agreement is held to be invalid the remaining terms shall remain in full force and effect.
I Have Read and Understand this Agreement and its Legal Consequences and Agree to be Bound by its Terms.
